HB 3105 will strip municipalities of the authority to regulate the oil and gas industry with their drilling ordinances. If this bill passes, the oil and gas industry can drill anywhere they want to in your cities.
H.B. 3105 (Keffer) – Regulatory Takings/Oil and Gas: would make a city regulation that damages, destroys, impairs, or prohibits development of a mineral interest subject to the Private Real Property Rights Preservation Act, which would:
- (1) waive sovereign immunity to suit and liability for a regulatory taking;
- (2) authorize a private real property owner to bring suit to determine whether the governmental action of a city results in a taking;
- (3) require a city to prepare a “takings impact assessment” prior to imposing certain regulations; and
- (4) require a city to post 30-days notice of the adoption of most regulations prior to adoption.
It is essentially the same as Bryan Hughes’ bill from last session, and would eviscerate your authority to regulate oil and gas drilling and related activities.

What is wrong with these politicians? They speak of FREEDOM but when it comes to telling the O&G Industry to get lost…they slink away and over to the corner of the room.
We've got to make these phone calls ASAP.

I think that BP has to pay for there mess. Other than the comesary that South Texans and surrounding areas are recieving They should fund a new Drill project to boost the Texas Economy. Since they have distroyed the possibility of local habitat there needs to be something to rely on. A matter of having BP Presidential politics move with the Texans and see what kind of Structure they can profit from. IE- Have BP fund 10 new drill factories.
