Did I read this right? Did Range hold their cooperation in the fracking study for ransom so the EPA would drop charges in the Lipsky case? And the EPA paid the ransom but left a family holding the bag?
Does anyone remember that a family in Parker County worked hard, built their dream and now have no useable water?
EPA changed course after oil company protested

Update: My favorite quote:
“They said that they would look into it, which I believe is exactly what they did,” Poole said. “I’m proud of them. As an American, I think that’s exactly what they should have done.”
Just precious.
About Sharon Wilson
Sharon Wilson is considered a leading citizen expert on the impacts of shale oil and gas extraction. She is the go-to person whether it’s top EPA officials from D.C., national and international news networks, or residents facing the shock of eminent domain and the devastating environmental effects of natural gas development in their backyards.

With the EPA withdrawing from the case gave the gas industry a major propaganda victory, will we now see the pendulum swing back to the facts of the case – lets hope so!
Tim Ruggiero says
Hmmmm. I wonder if David Poole is withholding damaging information, and calling it “proprietary” as the excuse not to release it? If the data worked in their favor, then Poole would be grandstanding. I wonder if he was waving a little flag when he announced he was an “American”?

Well, that’s quite a listing…I may not have time to go through it all, I’ms till trying to figure out why Bought Off Barry feels the need to pack heat. And that idiot Porter. Man can’t even string two sentences together, and he’s going to be walking around with a gun?
Khepry Quixote says
How would this revelation affect both the Lipsky’s case and the after-effects of the deposition you had to make to Range Resources concerning the Lipsky case (if memory is serving me correctly)? If it is true that the EPA threw the Lipskys back to the wolves, then doesn’t that make the argument that “sacrifice zones” will be practiced and the peasants be damned as well?
Andy Mechling says
EPA works in mysterious ways. Specifically, EPA Office of Enforcement works in mysterious ways. This action is business-as-usual for these guys. This time; a brave reporter caught them with their pants down. It will be interesting to see how this develops.
David Poole YOU are a piece of work. Clearly a rising star; congratulations.
Andy Mechling says
I got a brief chance to work with some folks at EPA enforcement several years ago. This was an eye-opening experience. Understand that these folks are professional blackmailers……and they’re proud.
They have access to all the best gear and labs. They go wherever they want. They DETEST ambulance chasing attorneys.
ALL of their actions are settled out-of-court. Always with consent decrees.
NONE of their data is ever made public. This time; the blackmailers got blackmailed.
Skeptical says
Great article by an awesome journalist. Is it a lie if you fail to present the WHOLE truth and nothing but the truth? I guess that’s up for debate.
Why no mention of the Federal District Court stay? Could that have had something to do with the decision to drop the Order?
By the way the Duke prof seems about as sharp as the SMU prof. There is no way you can say the geochemical fingerprint between two gas reservoirs separated by a mile of earth and millions of year are indistinguishable. Carbon isotopes, perhaps. Nitrogen, CO2, and microbiology will differ. Science 101. Trot out a global warming wacko to talk subsurface geology and that’s what you get.
Look, I’m not defending Range. I’m defending science and the right to due process. We have a judicial system so we don’t have to try to convict people in a court of public opinion.
TXsharon says
Of course you would be skeptical. You always are. But this time you where so cagey about it I was almost fooled.
Skeptical says
Thanks for giving me the opportunity to present my view. Believe me, I value your opinion and those of you that comment. I want clean air, clean water, and wide open spaces too. I believe we can and should hold bad actors accountable.
I disagree with your approch, but I respect it. The easiest way to burn the house down is from inside. You need to understand how the industry works and play that game. you have to have your facts straight and the science on your side – it’s the only way your going to be credible. I understand why your jaded.
The AP article won’t help the cause. I said “lie”becausenthe author intentionally left out facts that would have undermined her position. If she had a worthy argument, she would have acknowledged the other side.
Cathy McMullen says
The judicial process, that is rich, almost as rich as the bought and paid for judges. What about the Judge Trey Loftin? There is a great example of the judicial system at work.
Honestly, I don’t think it is easier to I don’t “burn the house down is from the inside” when you are locked out of the house. It seems to me the only ones with the keys to the “house” are industry and the bought and paid for judicial and political system.
You may not agree with Sharon’s approach but it is the only access the public has to the “house”.
Cathy McMullen says
The Kelly Hart and Hallman PAC was one of the largest monetary contributor to Trey Loftin’s run for re-election for judge. no conflict if interest in this judicial system is there? Kelly Hart’s Oil & Gas/Energy attorneys represent a diverse range of clients involved in all aspects of the energy industry in transactional, litigation and regulatory matters. Clients seeking our expertise include oil and gas exploration and development companies, energy investment groups, mid-stream companies, electric utilities, alternative energy providers and a wide variety of individuals, businesses and non-profit entities holding oil, gas and other mineral interests.

The EPA is a mysterious org, as you say Andy. Most of the time they hire “experts” and have them conduct studies (a lot of fracademia folks involved) and write reports. Most reports basically say that more study is needed. The EPA is not much help for the ordinary peasants against the GasHoles or other polluters.
Your Neighbor says
What about the water well drillers in Parker County who testified that this was a problem that existed way before the Barnett Shale drilling began? What did they have to gain from lying?
TXsharon says
What about the water well driller who testified the Lipsky well had no gas in it?
No gas.
Fracking and production happen.
Gas.
Your Neighbor says
It has gas just not from Barnett Shale.
Facts suck don’t they?
TXsharon says
Just remember you said that because I sure will.
