Imagine if your neighbor did something that made him very rich but ruined your property, cost you thousands of dollars and endangered your family’s health and safety. This American Dream turned nightmare happens everyday in the Barnett Shale–one person profits from the misery of another.
This used to be a horse pasture filled with green Bermuda grass and the horses that they love. Now they pay $1000/month to board the horses.
In Texas, we have what is called a “Split Estate.” That means one person can own the surface of a piece of property and another person can own the mineral rights under that property. The mineral owner has the right of eminent domain over the surface owner. Imagine the shock some people experience when, without notice, a bulldozer pulls onto the land they purchased and starts dozing over their trees. Then a noisy, smelly, drilling rig is installed–in Texas it can be only 200′ away–and life is never again the same.
The rig belches massive amounts of diesel fumes and the constant noise is unbearable. The rig never stops, even at night. You receive threats and intimidation to shut you up.
