The GP vs. MS ruling was fascinating. In short, it said that municipalities CAN impose zoing on entities that have eminent domain powers, as long as it doesn't disallow the purpose of excercizing the eminenet domain powers.
We have heard for years that "we can't do anything about pipelines" because "they are OK'd by the state and have eminent domain powers". This ruling punctures that position.
A city CAN and frankly SHOULD create zoning to protect it's citizens adn cannot be prevented from doing so by anyone.

That 'is' fascinating. I do believe this is very helpful to those of us who are hearing this line of reasoning from our cities. Thank you for pointing out that municipalities do have the power to zone against pipelines. Funny how they so easily side with industry more often than not. Fascinating. 🙂
